Terms of Service

1. Acceptance of terms

By accessing and using Elara (elara.onrewire.com), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree with any of the terms, do not use the service.

These Terms are complemented by our Privacy Policy.

2. Description of the service

Elara is a maturity assessment agent operated by On Rewire that enables organizations to evaluate their maturity level in:

• Data management, using the DAMA DMBOK v2 framework as a reference.
• Artificial Intelligence governance, using the ISO/IEC 42001 standard (Clauses 4-10 and/or Annex A) as a reference.

The service includes:

• Interactive questionnaire guided by a conversational agent
• Automatic generation of a personalized executive report using AI
• Report delivery by email
• Roadmap and quick-win recommendations

3. What Elara is NOT

It is important to understand the limitations of the service:

• Elara is NOT an official ISO 42001 or DAMA certification. Formal certifications require on-site audits by accredited bodies. Elara is a guidance-oriented self-assessment.
• Elara does NOT replace specialized professional consulting. The report is a conversation starter, not a definitive executive plan.
• Elara does NOT provide legal, financial, or regulatory advice. Recommendations do not constitute professional advice.
• Elara does NOT guarantee specific results. Implementation of recommendations depends on your organization.

4. Acceptable use

By using Elara, you agree to:

• Provide truthful and accurate information about your organization
• Use the service only for lawful and professional purposes
• Not attempt to access restricted parts of the system
• Not reverse-engineer, perform automated scraping, or attempt to replicate the assessment model
• Not use the service to assess third parties without their consent
• Not abuse the service through automated bulk submissions
• Respect On Rewire's intellectual property rights

Violation of these rules may result in immediate suspension of access, without the right to a refund.

5. Intellectual property

On Rewire's: the assessment models, scoring algorithms, agent prompts, the Elara brand, designs, and report structure are the exclusive property of On Rewire. You may not copy, modify, redistribute, or create derivative works without prior written authorization.

Your executive report: the specific content of the report you receive is free to use within your organization. You may share it internally, cite it in internal presentations, and use it as a basis for your initiatives. You may not resell the report or use it as your own product.

Your responses: you retain all rights to the data you enter. On Rewire uses them only in accordance with the Privacy Policy.

Reference frameworks (DAMA, ISO): "DAMA DMBOK" is a registered trademark of DAMA International. "ISO/IEC 42001" is a standard published by ISO. On Rewire is not formally affiliated with any of these entities; we use them as public methodological references.

6. Free service and limitations

As of the publication of these Terms, Elara is offered as a free service for assessment and commercial positioning purposes of On Rewire.

On Rewire reserves the right to:

• Modify, suspend, or discontinue the service at any time
• Limit the number of assessments per organization or IP
• Introduce paid plans in the future (with prior notice)
• Modify the reference frameworks evaluated

7. Limitation of liability

To the maximum extent permitted by law, On Rewire shall NOT be liable for:

• Business decisions made based on the report
• Direct, indirect, incidental, or consequential economic losses
• Inaccuracies in the analysis arising from imprecise user responses
• Temporary service interruptions due to maintenance or technical failures
• Actions of third parties (including the processors listed in the Privacy Policy)

On Rewire's total liability for any claim is limited to the amount actually paid by the user for the service in the last 12 months, which in the case of the free service equals USD 0.

8. Indemnification

You agree to indemnify and hold harmless On Rewire, its collaborators, processors, and representatives against any claim, demand, loss, or expense (including reasonable legal fees) arising from:

• Your breach of these Terms
• Improper use of the service
• Violation of third-party rights through the use of the service

9. Modifications to the terms

On Rewire may modify these Terms at any time. Modifications take effect upon publication on this site. For material changes affecting user rights, active users will be notified by email with 15 days' advance notice.

Continued use of the service after the publication of changes constitutes acceptance of the new Terms. If you do not agree, you must discontinue use of the service.

10. Applicable law and jurisdiction

These Terms are governed by the laws of the Argentine Republic, without regard to its conflict of laws rules.

Any dispute arising from these Terms or the use of Elara shall be submitted to the Ordinary Courts of the Autonomous City of Buenos Aires, Argentina, with express waiver of any other forum that may apply.

For consumer users in jurisdictions where local law provides consumer-protective forums (EU, Brazil, Mexico), the mandatory consumer protection provisions of their country of residence shall apply.

11. Severability

If any clause of these Terms is found to be invalid, illegal, or unenforceable in a jurisdiction, this shall not affect the validity of the remaining clauses.
